Purpose

This policy ensures that the JCCSF complies with the requirements of the Americans with Disabilities act of 1990 and is consistent with Section 504 of the Rehabilitation Act of 1973.

Policy

The JCCSF is committed to a policy ensuring that a person with disabilities is not discriminated against and that they have equal opportunity and equal access to all the rights and privileges enjoyed by those who are not disabled. While the ADA mandates equal access to individuals with disabilities, the JCCSF makes it a priority to establish an environment that also embraces the spirit of the ADA. Our goal is to create a nurturing environment that strives to permit each individual the opportunity to reach his or her own potential. To this end, the JCCSF is dedicated to enabling individuals to participate in appropriate social, recreational, cultural and educational experiences, whenever possible, through reasonable accommodation unless doing so constitutes an undue hardship and/or is not readily achievable.

Rights and Responsibilities

The JCCSF

  • Has the responsibility to make known through a variety of medium the types of assistance available to disabled participants.
  • Has appointed an Accessibility Coordinator who is available to meet with disabled individuals to discuss how best to support their needs.
  • Has the responsibility to review requests for accommodation in a timely manner.
  • Has established a process to review appeals and/or grievances about how the JCCSF has accommodated a disabled member.

Persons with Disabilities

  • Have the responsibility to identify themselves as needing appropriate, reasonable accommodations for persons with disabilities.
  • Have the right to confidentiality of all information regarding their disability. Persons with disabilities have the right to choose to whom information about their disability will be disclosed.
  • Have the responsibility for making their needs known in a timely manner.
  • Have the same obligation as any JCCSF participant to comply with JCCSF policies and procedures.
  • Have the responsibility to follow procedures for services for persons with disabilities.

Procedures

  • If a request for an accommodation is received: The request should be directed to the JCCSF Accessibility Coordinator.
  • The Coordinator, in consultation with the individual, shall discuss the potential accommodations and assess the effectiveness each would have in allowing the individual to fully participate at the JCCSF.
  • An accommodation will be selected that is the most appropriate for both the individual and the JCCSF. While an individual’s preference will be given consideration, the JCCSF is free to choose among equally effective accommodations and may choose the one that is less expensive or easier to provide.
  • The Accessibility Coordinator will provide a decision to the participant within a reasonable amount of time and will work with the participant to obtain technical assistance as needed.
  • If an accommodation cannot overcome the existing barriers or if the accommodation would cause an undue hardship on the operation of the business, the participant and the Accessibility Coordinator shall work together to determine whether other options exist to enable full participation.

To Determine an Undue Hardship

The Accessibility Coordinator will consider the nature and cost of the accommodation in relation to the size, financial resources, and the nature and structure of the operation, as well as the impact of the accommodation on the nature or operation of the JCCSF. The JCCSF may impose legitimate safety requirements necessary for the safe operation of its services, programs, or activities and may restrict or deny participation if an individual’s disability causes or potentially causes a direct threat to the health or safety of others. A direct threat is a significant risk to the health or safety of others that cannot be eliminated or reduced to an acceptable level by modification of policies, practices, or procedures.

Definitions

Disability means a physical or mental impairment that substantially limits one or more major life activities of the individual, a record of such an impairment, or being regarded as having such an impairment.

A reasonable accommodation is a modification or adjustment to the facility, program or policy that makes it possible for a qualified individual with a disability to enjoy equal participation at the JCCSF.

An undue hardship is an action that is unduly costly, extensive, substantial, or disruptive, or that would fundamentally alter the nature or operation of the JCCSF.
